Fatal accidents take the lives of hundreds of people in Illinois every year. Unfortunately, there are many instances where commercial vehicles are involved in these crashes. In Illinois, you can file a wrongful death lawsuit against various parties potentially responsible for the crash, including the truck driver, the trucking company, the maintenance company, and even manufacturers of faulty truck components if mechanical failure played a role.
To establish a wrongful death claim, you must demonstrate that the fatal crash resulted from a wrongful act, neglect, or wrongful default. In an 18-wheeler accident, this often involves proving negligence, such as driver fatigue, speeding, or improper maintenance.
It is important that you take legal action as soon as possible. Waiting to file your claim can result in the loss of witnesses, the loss of evidence, and other factors that will negatively affect your claim. This makes it important that you seek guidance from a knowledgeable fatal truck accident lawyer as soon as possible. Your attorney will be able to start working on your case and gather the strongest evidence possible.
