Truck Accidents in West Virginia

Beckley, WV – I-77 Truck Wreck near I-77/I-64 Split Ends in InjuriesTruck accidents leave thousands of people injured on a monthly basis. The unfortunate truth is that many truck accidents that we see here in the state of West Virginia are preventable. When people are negligent or reckless, they can cause serious accidents that leave victims with devastating injuries. Following a truck accident, several parties can be held liable for the damages suffered. These include:

  • Truck driver
  • Trucking company
  • Truck owner
  • The company that owns or leases the trailer
  • Cargo Companies
  • Truck, trailer, or parts manufacturer

Truck accidents often result in severe injuries, such as traumatic brain trauma, internal organ injuries, or even fatalities. These injuries often require extensive medical care and result in significant financial burdens for victims and their families. In order to seek compensation for the damages that you suffered as a result of the accident, you must be able to identify the active negligence that led to the accident taking place. Some common examples include:

  • Lack of adequate truck driving experience
  • Driving excessively without taking necessary breaks
  • Insufficient supervision of truck drivers
  • Inadequate training provided to truck drivers
  • Failure to monitor and regulate driver’s hours of service
  • Overloading of trucks beyond safe limits
  • Failure to observe other vehicles due to significant blind spots
  • Neglecting to maintain the tractor and/or trailer in a safe condition
  • Hiring unfit or unqualified truck drivers
  • Non-adherence to traffic laws and regulations
  • Selecting an unqualified or unsuitable truck company

To succeed in a negligence lawsuit, the injured party must demonstrate that the truck driver owed a duty of care to other vehicles on the road, the driver breached this duty through action or inaction, an injury was sustained, and the breach of duty directly caused the injury. In some instances, the owner of the trucking company, the manager, the truck owner, the driver’s employer, and their respective insurance companies may also be held liable following a crash.
