Fatal truck accidents take the lives of thousands of people across the United States every year. In the aftermath of the fatal accident, it is crucial that families are aware of the legal options they have.
After the loss of a loved one, your family has the ability to file a wrongful death claim against the responsible party. When it comes to truck accidents, there are several parties who can assume liability.
In most cases, the driver of the truck is identified as a person who assumes liability. This is due to the fact that the driver is the one operating the vehicle at the time of the crash. There are many cases where truck drivers are speeding, impaired, or engaging in other actions that directly cause the crash to take place.
In addition to the truck driver, the trucking company can also be held liable. This is particularly true in cases where the trucking company was negligent in the process of hiring the driver for the vehicle. If they did not verify that the driver was qualified to operate a vehicle, and an accident occurs, they can be held liable.
In addition, the cargo company, maintenance company, or another driver sharing the road can also be held liable. A thorough investigation performed by your commercial vehicle accident lawyer can help determine who is liable so that you can take action against them. Having a skilled legal team by your side can make a world of difference.
