Fatal Truck Accidents in West Virginia

Fatal accidents in West Virginia take the lives of hundreds of people annually. These accidents are often devastating, leaving families to deal with overwhelming consequences. Following the loss of a loved one, families have the legal right to pursue a wrongful death claim against those at fault. Truck accidents are more complex due to the fact that several people can be held liable. Typical parties identified in wrongful death cases include:

  • Vehicle and part manufacturers
  • Cargo loaders
  • Truck drivers
  • Trucking companies
  • Those responsible for maintaining the vehicles

The state of West Virginia is an at fault state when it comes to motor vehicle collisions. This means that the person who is responsible for the automobile collision will have to pay compensation for the damages and injuries resulting from the crash. This can include compensation for:

  • Property damage
  • Medical expenses
  • Pain and suffering of the deceased
  • Loss of companionship and consortium
  • Funeral and burial expenses
  • Lost future earnings and benefits
  • Loss of financial support

It is important to note that West Virginia is a comparative negligence state, which means that an individual is able to seek compensation for the resulting damages so long as the deceased party is less than 50 percent responsible for the accident. This makes it vital for you to seek guidance from a fatal truck accident lawyer right away.
