The state of North Carolina witnesses a significant number of fatal truck accidents each year. Many of these devastating accidents are a result of drivers who are negligent. Negligent actions that often cause fatal truck accidents include impairment, running red lights, passing stop signs, and operating a vehicle while distracted.
While filing a wrongful death claim against the driver may seem like the primary course of action for those who have lost loved ones in such accidents, it is important to recognize that multiple parties can be held liable. Seeking guidance from a wrongful death lawyer in Rowan County can help determine the responsible parties for your loved one’s tragic loss.
Various parties may potentially bear liability for the damages that your family has suffered as a result of losing a loved one in a fatal truck accident. In many cases, the trucking company holds responsibility for its maintenance. If the accident resulted from mechanical failure or negligence, the trucking company could be held accountable for the resulting damages.
Next, the cargo company becomes a potentially liable party if is determined that the employees acted negligently. Their responsibility lies in properly loading and securing the truck’s cargo. If improper loading or securing led to the accident, the cargo company may be deemed liable.
Additionally, the maintenance company that is responsible for repairing and maintaining the truck can be held liable if their failure to adequately fulfill these duties contributed to the accident.
