Fatal Truck Accidents in Nebraska

Sarpy Co., NE – One Killed in Truck Wreck on I-80 near Giles RdDealing with the sudden and unexpected loss of a loved one due to a fatal truck accident can be devastating. Unfortunately, thousands of people across the United States lose their lives as a result of accidents every year. After losing a loved one unexpectedly in a truck crash, you have the ability to file a wrongful death claim.

Typically, the individual who is operating the vehicle bears the liability for the accident taking place. However, when a commercial truck collides with a vehicle and causes fatal injuries, there are several situations in which other parties can also be held liable for the resulting damages. These include:

  • Hiring an Unqualified Driver: If the truck driver lacks a valid commercial driver's license (CDL), yet the trucking company still employs them, it could indicate negligence on the part of the trucking company.
  • Inadequate Truck Maintenance: The truck's owner is responsible for ensuring the vehicle receives proper maintenance and repairs. Neglecting to address known mechanical issues or failing to rectify them correctly may render the trucking company liable if these problems directly lead to mechanical failure, resulting in an accident.
  • Improper Cargo Loading: When the entity responsible for loading cargo into the truck's trailer makes mistakes, it can lead to issues such as overloading or unbalanced cargo, creating a hazardous situation for the driver and fellow motorists. Loading errors could cause cargo to shift during transit, potentially resulting in the driver losing control of the vehicle.
