Fatal truck accidents take place far too often. These incidents take the lives of hundreds of people every month in the United States. Unfortunately, families often face significant financial burdens due to these types of accidents. After losing a loved one, your family can file a wrongful death claim against the person who is responsible. To recover damages, you must be able to prove the defendant is liable.
Determining liability in a commercial truck accident case requires establishing negligence by the truck driver or the trucking company. It is essential to prove that they failed to exercise the necessary level of care for other drivers on the road, resulting in a fatal crash that claimed the life of your loved one and caused you to suffer damages.
Negligence can be apparent in various ways in truck accidents. Some common factors contributing to fatal truck crashes include insufficient truck maintenance, excessive speeding, driver fatigue, inexperienced drivers, and aggressive driving.
When a loved one's life is unexpectedly taken in a truck accident, pursuing a wrongful death claim may be an option to seek compensation from the responsible parties. These parties can include the truck driver, insurance company, trucking company, or other entities deemed liable.
A wrongful death claim allows certain family members of the victim to seek damages that include loss of companionship, emotional distress, and financial support. Given the complexity of truck accident cases, it is strongly recommended to seek assistance from a skilled and knowledgeable multi-vehicle accident lawyer who can protect your best interests throughout the legal process.
