Fatal Truck Accidents in Utah

Taylorsville, UT – Man Loses Life in Truck Crash on I-215Fatal truck accidents are the cause of hundreds of deaths every year in the United States. Unfortunately, our state is not immune to these devastating accidents. We see countless families forced to deal with the overwhelming consequences that these fatal accidents bring.

After experiencing the loss of a loved one due to a fatal accident, your family may be able to take legal action against the party who is responsible. To recover financial compensation from the responsible party, you must be able to establish negligence. In order to do so, you must demonstrate that the four elements of negligence existed at the time of the crash. This includes demonstrating the following:

  • Duty of Care: The victim must demonstrate that the defendant was legally obligated to act reasonably while operating their vehicle.
  • Breach of Duty of Care: The claimant must establish that the defendant did not fulfill their duty of care by engaging in negligent or reckless behavior.
  • Causation: It is necessary to show that the injuries sustained by the claimant were a direct result of the defendant’s actions that caused the breach of duty.
  • Damages: The claimant must provide evidence of the losses and damages they have suffered as a result of the defendant’s breach of duty.

Whether the legal claim is filed against the truck driver, truck owner, trucking company, parts manufacturer, or loading company, it is crucial to be able to establish the existence of these elements for the claim to succeed.
