For more than 70 years, truck driver fatigue has been recognized as a major cause of trucking accidents. According to the Federal Motor Carrier Safety Administration, more than 65 percent of truck drivers have reported that they often or sometimes feel drowsy while driving. Approximately 50 percent of drivers admitted that they fell asleep while driving within the previous 12 months. Further, about 13 percent of truck drivers were fatigued at the time of a reported collision.

Hours of Service Regulations

Among these rules, are what has become known as the hours of service rules. These rules limit the amount of hours that a driver can be behind the wheel. They also provide for mandatory driving breaks and sleep periods prior to operating a commercial truck. Some of the hours of service regulations are as follows:

  • Maximum driving limit of 11 hours per day after 10 consecutive hours off duty
  • Required 30-minute driving break after 8 consecutive hours of driving
  • Drivers may not drive more than 60 hours in any consecutive 7-day period and may not drive more than 70 hours in an 8-day period. Following the end of a 7 or 8-day period, drivers must take 34 or more consecutive hours off duty.

Hours of Service Violations

While the hours of service regulations are in place in order to reduce and eliminate fatigued and drowsy driving crashes, not all truck drivers and trucking drivers are compliant with the rules. In fact, hours of service requirements are among the most violated safety regulations. What are the consequences of violating these regulations?

  • Fines: The FMCSA can impose fines ranging from $1,000 up to $16,000 for violations of safety and service hour regulations
  • Forced Shut Down: Trucks that are found to be in violation of the hours of service requirements may be forced to shut down and remain on the roadside until the driver has rested for the required amount of time
  • Reduction in accountability, safety, and compliance scores
  • Federal criminal penalties: Trucking companies who commit willful and serious violations of federal service regulations can face criminal penalties. This is more likely to occur with repeat serious offenders.
