Truck accidents claim the lives of numerous individuals in Arizona every year. Unfortunately, many of these incidents stem from acts of negligence. When a fatal accident involves a large truck, the truck driver, trucking company, truck owner, and even the manufacturer of the truck or its components can potentially be held responsible.
In Arizona, similar to most states, primary responsibility for a fatal accident typically falls upon the truck driver. This is because the driver operates the vehicle and has a duty to ensure that they are doing so in a safe manner. If the driver was traveling too fast, under the influence, or switching lanes in a reckless manner, they are likely to be held liable for any resulting accidents or fatalities.
The trucking company may also be held liable if they were negligent in hiring or supervising the driver, failed to maintain the truck properly, or violated federal and state regulations.
The truck owner may be held liable if they were aware of or should have been aware of any safety issues with the vehicle but neglected to address them. Finally, the manufacturer of the truck or its parts may be held liable if there were defects in the design or manufacturing that rendered the vehicle unsafe.
